Ontario Tenant Rights — Cleaning and Your Last Month's Rent Deposit
In Ontario, landlords cannot hold a traditional "damage deposit." The only deposit permitted under the Residential Tenancies Act (RTA) is a last-month's-rent (LMR) deposit, collected at the beginning of the tenancy. When you move out, that deposit must be applied to your last month's rent — the landlord cannot withhold it for cleaning costs unless they go through the Landlord and Tenant Board (LTB).
The Critical Distinction
A landlord who believes a departing tenant left the unit in an unreasonably dirty condition cannot simply keep the LMR deposit. They must:
- Apply the LMR deposit to the last month's rent (as required)
- File a claim with the LTB for costs beyond the deposit
- Appear at an LTB hearing and prove the cleaning costs with evidence
This is an important protection for Ontario tenants that many landlords (especially individual investor-owners) either don't know or choose to ignore. If a landlord refuses to apply the LMR deposit to last month's rent, or attempts to keep it for cleaning without an LTB order, they are in violation of the RTA.
What Evidence the LTB Considers
At an LTB hearing, both parties present evidence. The landlord needs to show the unit was not returned in reasonable condition. You can counter with:
- Professional cleaning receipts with the service date and scope
- Timestamped before-and-after photos from the cleaning company
- Photos of the unit that you took yourself on move-out day
- Your move-in inspection report showing the condition when you arrived
Why Professional Cleaning Documentation Matters
A professional cleaning invoice from Maidless includes: the date of service, the scope of work, the address, and our HST number. Combined with our timestamped before-and-after photo report, you have clear evidence that professional cleaning was performed to a documented standard. This is the strongest possible defense against an LTB cleaning claim.
